2hives Partner Terms
Version 2026-10-31-r2a. These terms are between 2BEE FARM PTY LTD (ABN 57 697 830 461), which operates the 2hives service ("we", "us"), and the business that joins the 2hives partner programme ("you"). They sit on top of our Terms and Privacy Policy. They are governed by the law of Victoria, Australia. A business in another country can join for a free listing on these terms; where the law of its country gives it rights that cannot be excluded by contract, those rights stay. Paid packages are sold only to businesses in Australia until we publish a country schedule; anything in these terms about price, packages or paid plans applies only to a business in Australia. These terms are in English; if you are not sure what they mean, write to info@2hives.com before you accept.
The short version
- Listening on 2hives is free for everyone, for good. Nothing in these terms changes that. These terms are only about your business's partner listing.
- Your listing is free for your first 6 months. We can cut that short only for the reasons in clause 8, or if the law requires it.
- After that it stays free until we start a paid plan, which is never automatic: you would choose whether to join, with at least 60 days' notice. After the first 6 months we may also end a listing on 60 days' written notice (clause 3.3).
- Nobody pays anything today. We take no card details, and we will never charge you without your clear written yes to a separate paid plan.
- You do not have to display a sign, mention 2hives to customers or bring us listeners to keep your free listing. We do not check, and we will not change your listing because you do not.
- You can leave at any time, at no cost.
- We give you 60 days' written notice before we change these terms, what a listing costs, or how we count.
- We count real adult listeners. We tell you the rules, show you your totals (a total of 1 or 2 is shown as "fewer than 3"), and let you challenge a count.
- The counts are information for you. They do not decide whether your listing stays free.
1. What a partner gets
- Two placements of your business name, one short line (up to 80 characters), a picture and a link, shown only to adult 2hives users whose approximate location is near the areas you serve (an estimate that can be wrong by some kilometres). In Australia we set the distance for you from how built-up those areas are: about 5 km in dense inner-city areas, up to about 25 km in rural or remote ones (the page for your business shows the figure). In other countries a listener counts as near when the town or city of their connection, or the place they saved, is one of the areas you listed; there is no distance. In the European Economic Area, the United Kingdom, Switzerland, Liechtenstein, Canada, China, India and South Korea we do not use the place of a listener's connection, so there your card is shown only to listeners who typed a place themselves. Expect few or no views there. We do not promise any number of views. The placements are: (a) A start line. While a session is being prepared, before any audio, one line of text with your business name and a small logo, labelled "Ad · Local partner: <your business name>". It is silent: it is never spoken or played, it is not a popup, it needs no tap, it goes away when the audio starts, and it is never shown during a session. (b) A partner card after a finished session, labelled "Ad · from our partner", as before. Each placement is shown at most once per user per day. Neither is shown before or after a sleep or nap session. Users can tap the start line or the card to see why they are seeing it, report it, and turn partner cards off. In the rest of these terms, "your card" means both placements.
- An entry in the Local partners list, if we offer one.
- A business page with your own QR code, link and short code, an optional printable counter sign, and your monthly counts.
- We do not promise any number of views, scans or sign-ups. We are early and local.
2. The listing and listening
- Listening is free for every person, whether or not they came through a partner. The conditions in these terms apply to the partner listing only, never to listening.
- The start line and the card are advertisements, and we label them "Ad" so that this is clear at first sight. Neither is a recommendation of your business by 2hives, and we say so on the "Why am I seeing this?" screen. The start line says "Local partner", never "sponsored by" or "supported by": your listing is free, and you do not pay for it or fund 2hives. The word "partner" names this programme only: it does not mean that we are in partnership with you, or that we vouch for your business.
3. Term, cost and leaving
- Starter period. Your listing starts on the later of the day we first approve your card and the day your QR code and short code are working and being counted (we tell you that day in writing). It then runs for 6 months. During it we may suspend or end your listing only for a reason listed in clause 8.
- Cost. Today there is no fee. The listing is a free promotional offer from 2hives: you owe 2hives nothing in return. In particular you are not required to display a 2hives sign or QR code, to mention 2hives to your customers, or to bring us any listeners; we do not check whether you do; and we will not remove or change your listing because you do not. Until a paid plan starts and you accept it in writing, your listing is free whatever your count is. Nothing you do, or fail to do, creates a debt. Because nothing is paid for the free listing, we do not expect either of us to need a tax invoice for it or for any sign you choose to display. This does not limit any right either of us has under tax law.
- After the starter period the listing carries on month to month. You can end it at any time. We can end it on 60 days' written notice, or sooner for a reason in clause 8.
- You can cancel at any time, from your business page or by email to info@2hives.com, with no fee, no penalty and no minimum period. The listing ends on the day you ask, or at the end of the month if you prefer.
- If we stop the programme we give you at least 60 days' written notice, or until the end of your starter period if that is later. If you have paid us anything, we refund the unused part.
4. Counting listeners
- An activated listener is a person who: (a) signs up for a new 2hives account through your QR code, link or short code; (b) confirms at sign-up that they are 18 or older; and (c) listens for at least 10 minutes in total within 14 days of signing up.
- One business per listener. If a person used a QR code or link and also typed a short code, the short code they typed counts. A person who already had a 2hives account, or who signed up before your listing started, does not count. A person who joined through your QR code, link or short code sees your card first for 12 months after the first touch.
- Which month. A listener counts in the calendar month (Melbourne time) in which they signed up. A month's count is final 15 days after the month ends, once every 14-day window has run. Your business page shows the final count for each month.
- Rolling average. Your average for a month is the number of activated listeners counted in that month and the two months before it, divided by the number of those months you have had (up to 3). Your first month counts from the day your code was working.
- Grace month. Once in any rolling 12 months we leave out your weakest month from every average that includes it. This is applied automatically. Months in which your card was suspended, or your code was not working, for a reason that was not your fault are always left out of the average.
- The target is an average of 5 activated listeners.
- What this means. The count, the average and the target are information for you. They do not decide whether your listing is free, and nothing you do or fail to do about them changes your listing. They could matter only if you later accept a paid plan whose written terms say so (clause 6).
5. Honest sign-ups only
- You must only encourage real adults to sign up to 2hives because they want to listen. You must not pay, reward, or offer any prize, discount or other benefit to anyone to sign up or to listen. You must not sign up yourself, your staff, your family or your friends to raise your count, create fake accounts, or use bots, scripts or paid sign-up services.
- You may display your sign, QR code, link and short code in your premises and your own channels, tell customers about 2hives, and hand out our flyer.
- Do not offer anything in return for ratings or reviews of 2hives, and do not post reviews of 2hives on anyone's behalf.
What we leave out of your count. We leave out only: a second account made by the same person (the same email address or the same device record); an account whose holder told us they are under 18; a sign-up with a temporary or disposable email address from a published list; an account that you, your staff or your family opened, where you or they tell us or our records show it; an account created by a script or bot; and a sign-up you or your staff paid or rewarded someone to make, where our records or the person tell us so. More than 2 sign-ups from the same network address in a month are held and checked together (see the next paragraph) rather than counted automatically.
Shared Wi-Fi. Many customers can honestly sign up on your shop's Wi-Fi or a mobile network. Sign-ups over the limit from one network address are held for review and counted if they have different email addresses and different device records and each shows normal listening. We tell you the result and why.
Reviewing a count. Before we exclude sign-ups, suspend you or end your listing because of this clause, we tell you which sign-ups (without personal details) and why, and give you 10 business days to respond. Someone who was not involved in the first decision reviews your response and tells you the result in writing within 10 business days. If our own records do not support an exclusion, we reverse it. While a review is open we keep the records it needs. We adjust the count; we never take back money you have received. You can use the outside help in clause 13 at any point.
6. If a paid plan is ever offered
- There is no paid plan today. We may offer one later; we have not decided whether we will, or what it would include. If we do, the plan's own written terms will state the price (including GST), whether and how activated listeners reduce it, how that is treated for GST, and the start date. Nothing in these terms promises that a plan will include a reduction or any particular target. No plan can take the price below nothing.
- We will give you at least 60 days' written notice of the price, the discount and the start date.
- A paid plan applies to you only if you agree to it in writing, in a separate step. If you do not agree you are not charged, and your listing continues on the free basis in clause 3: we can end it only on at least 60 days' written notice (clause 3.3) or for a reason in clause 8, and you can leave without cost.
- We will never take payment, keep card details or bill you automatically without your express consent, given after you have seen the price.
- We will not change the price, the target or the discount of a plan you have accepted without 60 days' written notice and your right to leave at no cost in that time.
- Tax. Prices include GST, and 2BEE FARM PTY LTD is registered for GST. If a plan reduces a price because of listeners you bring, the plan's written terms will say how that is treated for GST and which invoices each of us gives. We give a tax invoice for a taxable supply to you if you ask. We will not pay you money or give you credit that can be exchanged for money, and a reduction does not carry forward as credit. You are responsible for your own tax and should ask your own adviser.
7. What we ask of every partner
- Be accurate and be you. You have the right to run the business and to use its name, picture and link. Your card, your sign and what you say about 2hives are true and not misleading.
- The sign is your choice. You do not have to display it, and it is not payment for the listing. If you choose to display the "2hives partner" sign, show it as we made it, in good condition, and take it down within 7 days after you leave.
- If you choose to recommend 2hives, say it is a partner arrangement. We do not require you to recommend it. When you or your staff do, say that your business is a 2hives partner and that it benefits from the listing, for example: "We're a 2hives partner. 2hives lists our business on its website, which benefits us." Any written or online mention must begin "We're a 2hives partner". Do not say anything untrue about how you use 2hives or what it did for you.
- No health claims. 2hives is relaxation and meditation audio. Your card, sign and words must not say or suggest that anything cures, treats, relieves or prevents an illness or condition, or promise results.
- Categories we do not list. Alcohol, tobacco, vaping and cannabis; gambling; politics and elections; weapons; adult content; health claims, weight loss, supplements and therapeutic goods; crypto, lending and investment offers; multi-level marketing and income opportunities; services aimed at under-18s; other meditation, sleep or mindfulness apps; psychology and counselling. Registered health practices (for example a GP, dentist, physiotherapist or pharmacy) are not listed at the moment. If we add a category to this list, it does not apply to a partner already approved until that partner's starter period has ended and we have given 60 days' written notice (clause 9). During the starter period we remove a card only for a reason in clause 8.
- Plain wording. One calm line. No urgency, shouting, prices or statistics we cannot check.
8. Approval, suspension and ending
- We check every business and card before it is shown. An automatic check runs first and a person at 2hives decides, normally within 5 business days. Cards that need a closer look, for example anything near a health claim, need two people. If we say no we tell you why, and you can ask for a different person to look again.
- We may suspend a card, but not end the agreement during the starter period, only for: a card or sign that is false or misleading; a health claim; a category we do not list; a breach of clause 5; a complaint we have checked and you have had a chance to answer; or a legal requirement. A person at 2hives makes the decision and you can ask for it to be reviewed under clause 13. We tell you the reason within 2 business days. Unless safety or the law needs faster action, you have 14 days to fix the problem before we remove the card.
- We take down a card within 2 business days of a complaint about it, and straight away for a health or safety concern. A takedown is a suspension, not a finding that you breached these terms. The days it lasts are left out of your average. If a suspension turns out to be wrong, we add the days lost to your starter period.
- You may leave at any time (clause 3). We may end the agreement on 60 days' written notice after the starter period. During the starter period we may end it only if you do not fix a breach of clause 5 or 7 within 14 days of our written notice, if the law requires it, or if continuing would put listeners at risk.
- When the agreement ends we stop showing your card and delete your business page and team list within 90 days. We keep only the monthly totals (no personal information) and records the law requires us to keep.
9. Changes to these terms
- We may change these terms only by giving you 60 days' written notice at the email address on your business page, saying what changes and why.
- During the notice period the old terms stay in force. If you do not like the change you can leave without cost before it applies.
- We do not change the starter period for a listing already approved, and we do not count anything against you that happened before a change.
- A change the law requires may apply sooner, and we tell you.
10. Your data and our reports
- We tell you totals only, never a listener's name, email, location or listening, and never a list of people. You must not try to identify listeners from our totals.
- Monthly report. After each month closes (clause 4.3) we email and show on your business page: QR scans, start-line views, card views, card clicks and your final activated-listener count. A total of 1 or 2 is shown as "fewer than 3". This applies to every figure while no paid plan exists, and we do not show a rolling average while no paid plan exists (it could reveal a small count). If a paid plan starts and your count decides what you pay, you will see your exact count, because you are entitled to check it. We do not send live or per-sign-up notices. In a dispute we give you counts by week, never names or times, and a week with 1 or 2 is also shown as "fewer than 3".
- The report is a service message about your listing. It contains no offers. Each report carries an unsubscribe link; unsubscribing from reports does not end your listing.
- We hold your business details, your team members' names and emails, your card and its history, and the counts. See our Privacy Policy, section "Business accounts".
- If a user presses your card they leave 2hives, and your own privacy policy applies to what you collect.
11. Names, logos and no agency
Nothing in these terms makes you our agent, representative or promoter, and 2hives does not pay you to promote it.
You let us use your name, logo, picture and link on your card and in the Local partners list while you are a partner. We let you display the "2hives partner" sign and the 2hives name for that purpose only, and you stop when you leave. Neither of us gets any other right in the other's brand.
12. Responsibility
- You are responsible for your card, your offers and what you say about 2hives. We are responsible for how 2hives works and for the counts we publish.
- Mutual cap. Each of us limits its total liability to the other under or about these terms to the greater of A$100 or the fees you paid us in the 12 months before the claim. The cap does not apply to fraud or wilful misconduct, infringement of the other's intellectual property, breach of privacy or data-protection law, or anything the law does not let us limit.
- Your content. You will cover us for loss we suffer, and third-party claims against us, because your card, your picture, your link or what you say about 2hives is false or misleading, is unlawful, or infringes someone else's rights. This is not limited by the cap above, but it covers only loss caused by your content. We stay liable, within the cap, for a miscount or a wrongful suspension (clauses 5 and 8).
- Neither of us is liable to the other for indirect or consequential loss. This does not limit liability for fraud or wilful misconduct, or anything the law does not let you limit. Putting right a wrongful suspension or a miscount (clauses 5 and 8) is in addition to any other right you have.
- Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or other law that cannot be excluded.
13. If we disagree
This clause does not limit your right to go to court or to a regulator, or to ask for outside help at any point.
- Write to info@2hives.com or use "Dispute a decision" on your business page. We confirm receipt within 2 business days and answer in writing within 10 business days, with our reasons and the numbers we relied on.
- If you are still unhappy you can ask for a further review by a person who was not involved. We answer within 10 business days.
- If it is still not resolved, either of us may ask for help (you may also do this at any time) from the Victorian Small Business Commission (VSBC), the small business commissioner or ombudsman in your own state or territory, or the Australian Small Business and Family Enterprise Ombudsman. Mediation by these bodies happens only if both of us agree. This does not limit your right to go to court or to a regulator.
- We will not act against you for raising a dispute in good faith.
